NATATANDAAN ba ninyo ang
kasong inireklamo ni G. Isaias Samson Jr. laban sa Sanggunian sa Department Of
Justice (DOJ) na naging kontrobersiyal dahil sa pagbibigay na noon ay siya pang
kalihim ng katarungan na si Sec. Leila Delima ng “special treatment.”
Nag-protesta noon ang libo-libong miembro ng Iglesia Ni Cristo sa ginawang ito
ni Delima na pagbibigay ng “special treatment” sa nasabing kaso na siya mismo
ang personal na nag-asikaso. Ang hiling noon ng kapatiran ay hayaang dumaan sa
“legal na proseso” ang kaso at huwag itong pakialaman ng kalihim ng katarungan.
Na siya namang nararapat, nanaig ang kahilingingan ng kapatiran na ang kaso ay
dumaan sa tama at legal na proseso na wala ang personal na pakikialam ng
kalihim ng katarungan.
Tandaan natin “reklamo” pa
lang laban sa Sanggunian ang isinampa ni G. Samson sa DOJ. Sa tama at legal na
proseso ay dadaan pa ito sa “preliminary hearing” upang pagpasiyahan ng opisina
ng taga-usig (prosecutor’s office) kung isasampa sa korte bilang kaso ang
nasabing reklamo. Kapag nasampa lamang sa korte ay saka pa lamang tatakbo ang
kaso na kabilang na ang pag-aresto sa inakusahan, ang hearing at trial,
hanggang sa umabot na ang korte sa pagdesisyon sa kaso (bagamat kahit
magdesisyon na sa kaso ang mababang hukuman ay maaari pa ring maghabol sa
mataas na hukuman).
Sa “preliminary hearing” ay
titingnan ng mga taga-usig (prosecutors) ang bigat ng reklamo kung may “probable
cause upang umusad ang kaso. Pagkatapos ng preliminary hearing ay gagawa sila
ng resolusyon kung saan ibabatay ang hatol sa reklamo kung ibabasura o iuusad
sa korte.
Noong Nobyembre 6, 2015 ay
isinagawa ang pagdinig ng DOJ sa reklamong isinampa ni G. Isaias Samson, Jr.
laban sa Sanggunian ng Iglesia na ito ang mga sumusunod: illegal detention,
threaths at coercion. Dumalo sa nasabing preliminary hearing sina G. Samson, at
ang kaniyang asawa at anak. Subalit, ang mga inaakusahan na kasapi ng
Sanggunian ng Iglesia Ni Cristo ay kinatawan lamang ng kanilang mga abogado.
[May mga media outfits na
ginawang “sensational” ang pagiging wala ng mga inaakusahan sa nasabing
preliminary hearing. Ang sabi ng isang news agency ay “no show” at ng isa ay “Sanggunian
snubbed.” Kataka-taka na pati ito ay gawing “sensational” ng mga iresposableng
media outfit na ito sapagkat alam naman nilang sa ganitong hearing ang mahalaga
ay naroon ang abogado ng inaakusahan, o ng nag-akusa man, kahit wala sila roon,
liban na sa kung talagang iutos ng korte.]
Ano ang tunay na kalagayan ng
nasabing reklamo na isinampa nina G. Isaias Samson, Jr.? Kunin natin ang pahayag
ng third party upang huwag tayong maakusahan na “bias”:

Philippines – The Department of Justice (DOJ) is expected to resolve with
fairness the criminal charges filed against leaders of the Iglesia ni Cristo
(INC) by expelled minister Isaias Samson Jr., a lawyer said yesterday.
Lorna Kapunan
expressed the belief that Justice Secretary Alfredo Benjamin Caguioa would
resolve the charges based on the merits of the case.
“The complaint
against the INC has attracted attention, and I’m sure whatever decision the DOJ
arrives at will elicit reactions either way,” Kapunan said.
“It’s important
that the issues raised in the complaint are carefully threshed out,” she added.
Kapunan said
Caguioa is expected to rule on the case in accordance with the law.
She added that
Caguioa does not have a political agenda.

Samson has
accused INC officials of harassing and detaining him and his family for

inaasahan na maggagawad ng pantay na pasiya sa reklamong isinampa ni G. Samson
laban sa Sanggunian. Inaasahan na magpapasiya si Justice Secretary Alfredo

“A criminal
defense expert on Thursday foresees the dismissal of the
criminal complaint for “harassment, illegal detention, threats and coercion”
filed by ex-Iglesia ni Cristo minister Isaias Samson against officials of the
INC, which is currently awaiting resolution by the Department of Justice.
“As I suspected,
the case against the INC leadership is weak and will most likely lead to the
dismissal of the case against the INC leadership,” said veteran and respected
lawyer Sigfrid Fortun, who in an earlier statement pointed out that the
complaint filed by Samson suffered from glaring legal infirmities.
According to
Fortun, the complaint, which was published online by several news services,
“contains flowery prose that make for a good read.”
“However, there
may have been a failure to pinpoint the ultimate facts that establish probable
cause for the criminal offenses Mr. Samson was complaining about. That’s what’s
vital for their case to prosper,” Fortun explained.
The seasoned
litigator noted that there were numerous allegations regarding the taking of
cellphones and computers from Samson and his family members, “but the curious
thing is no charges for theft or robbery were made—most likely because none of
these articles belonged to the Samsons.”
There were
likewise allegations of INC officials misappropriating money but there wasn’t
any criminal complaint for estafa, Fortun added.
“Among other
things, there was a complaint for ‘harassment,’ which is not even defined as a
crime in the Revised Penal Code,” stressed the UP-trained lawyer.
Fortun also said
the term “house arrest” was liberally used in the complaint, “yet any decent
competent lawyer will tell you that no order of arrest can be issued by private
individuals. Only the state can have a party arrested.”
“If I noticed
these issues, then no doubt the lawyers prosecutors in the DoJ have likewise
spotted them as well—and they will have no choice but to dismiss the case.”

“THE Department of Justice (DOJ) has dismissed
the criminal complaints against the leaders of Iglesia Ni Cristo (INC) for lack
of probable cause.
In two separate
resolutions, the DOJ dismissed the separate complaints of expelled INC Minister
Isaias Samson and expelled INC member Jose Fruto against the members of Sanggunian,
the INC’s highest administrative body.
“In dismissing
Samson’s complaint, the DOJ said the “complainant failed to offer proof
that he was compelled to do something against his will when he was allegedly
forced by respondent to execute a written statement admitting his culpability
and complicity in the Ebangelista blog.”
“The DOJ added
that Samson failed to preasent an “iota of evidence” on his alegation of
intimidation and confiscation of his passport, service vehicle, laptop, mobile
phone and other personal effects.
“There is
nothing in the recitation of facts made by complainant which shows that
reposdents resorted to threat, violence and intimidation whne the said vehicles
were taken allegedly upon orders of the Sanggunian,” the resolution stated.
“On Fruto’s complaint,
the DOJ stated that his allegation of harassment due to the filling of criminal
cases against him has been the subject of judicial proceedings.
“The DOJ addedd
that there ws also no evidence to support his allegation of robbery as he was
not even in his house when the crime was allegedly committed.
“The resolution
was signed by Senior Deputy State Prosecutor Theodore Villanueva, Assistant
State Prosecutors Olivia Torrevillas and Mark Roland Estepa and approved by
Prosecutor General Claro Arellano.”

tinutupad Niya ang Kaniyang pangako sa Sugo ng Diyos sa kasalukuyang Namamahala
sa Iglesia, ang kapatid na Eduardo V. Manalo (cf. Isa. 41:9-16).

ReplyDeleteMaraming salamat sa Dios at muli nyang ipinagtanggol ang kanyang banal na Iglesia at ang ating mahal na tagapamahala at ang sanggunian. Maraming salamat po sa walang sawang pag update ng mga information.Mabuhay po kayo.Hay naku ! makahinga na ako ng maluwag ngayon.Mabuhay ang Iglesia ni Cristo! Sa Dios ang kapurihan.

ReplyDeleteSa simula palang ,hindi ako napanghinaan ng loob ng marinig ko ang mga balita,,sapagkat alam natin itoy isang pagsubok na haharapin ng IGLESIA,,at kasama na dito ang pagsubok lalo sa bawat isang mananampalataya,,salamat AMA at ng ating PANGINOONG JESUS,lalong lumalakas ang aming pananampalataya,,na anomang pagsubok na aming haharapin ,,tatayo kaming matatag at kailanman hindi magtataksil.
ReplyDeleteAng tunay na mananampalataya ay matibay at d natitinag dumating man ang matinding pagsubok bahagi ito ng ating pagka INC at dito rin masusubok ang tunay na mananampalataya ,,ang matatag mananatili,subalit ang mahihina mabubuwag,salamat AMA at ng ating PANGINOONG JESUS,,ang pagmamahal na ipinaramdam nyo sa amin ay tunay na lalong nagpapatibay sa amin .na laging nasa panig ka ng iyong mga tunay na kawan .. purihin ang AMA at ng ating PANGINOONG JESUS .
